Child of a Married Woman

Child’s surname can be that of:

  • the surname of the husband, if he is the Father;
  • the surname of the Mother, or
  • hyphenated or combined surnames of both parents.

Note: if the husband is not the Father, then the Mother must complete a statutory declaration stating this and no particulars of the Father will be stated, unless both the Mother and the person acknowledging himself to be the Father, jointly request that in writing by completing a statutory declaration.

Child of an Unmarried Woman The child’s surname will be the same as the mother’s surname, unless section 27 of the Registration of the Live Birth form is completed by both Mother and Father. Then, the child’s surname can be that of the:
  • surname of the father,
  • surname of the mother, or
  • hyphenated or combined surnames of both parents.
Child of a Widowed or Divorced Woman The child’s surname will be the legal surname of the Mother, if the child was conceived after the mother was widowed or divorced. However, if the mother and father complete section 27 of the Registration of the Live Birth form, then the child’s surname can be that of the:
  • surname of the father,
  • surname of the mother, or
  • hyphenated or combined surnames of both parents.
